The difference between parenting time and visitation.

Visitation and parenting time mean exactly the same thing under Michigan law. The term visitation is old and more appropriate for visiting someone in prison than enjoying time with a child. Some time ago, in an effort to avoid marginalizing or insulting a parent, courts began replacing visitation with the term parenting time, a kinder and gentler way to describe the frequency and duration each parent spends with a child under a court’s order.

Under Michigan law, it is presumed to be in the best interest of a child to have a strong relationship with both parents and the court is required to entered an order that is reasonably calculated to promote that relationship. However, that does not necessarily equate to equal parenting time. Rather, the court must examine the parenting time rules in making a parenting time or visitation decision.
