Michigan divorce law provides authority to request the court to order the other party to pay all or part of the divorce attorney fees related to a divorce, including post-divorce proceedings.  The law is found in Michigan Court Rule 3.206(C).

The Michigan Court Rule regarding provides that a party requesting contribution towards their divorce attorney fees must allege:

  • The party is unable to bear the expense of the action, and that the other party is able to pay or
  • The attorney fees and expenses were incurred because the other part refused to comply with a previous court order, despite having the ability to do comply.

Michigan also has a statute on divorce attorney fees.  The statute is Michigan Compiled Laws 552.13(1).  The Michigan statute on divorce attorney fees provides:

“In every action brought, either for divorce or separation, the court may require either party .  .  .  to pay any sums necessary to enable the adverse party to carry out or defend the action.  .  . “
