Makeup parenting time is warranted when one party has wrongfully been denied parenting time. Parenting time can be defined as the frequency and duration each party spends with the children. Parenting time is typically set forth in a Parenting Time Order or with a Judgment of Divorce or Custody. Michgan’s parenting time statue can be found in Michigan Compiled Laws Section 727a. The Makeup Parenting Statute can be found in Michigan Compiled Laws section 552.642.
Typically, when one party complains that he/she has been denied parenting time they have three options. First, file a parenting time complaint with the Friend of the Court. Second, file a Motion for Make up Parenting time or Third, file a Motion to Show Cause.
The Makeup Parenting Time Statute requires a court to establish a makeup parenting time policy which shall include the following minimum requirements:
- Makeup parenting time shall be the same type and duration as the parenting time denied (e.g. weekend parenting time for another weekend, holiday parenting time for anouther holiday.)
- Makeup Parenting Time shall be taken within 1 year of the denied parenting time.
- The parent who was denied parenting time shall choose the makeup parenting time.
- A requirement to notify both the friend of the court and the other parent within 1 week before making use of a makup weekend and not less than 28 days before making use of a holiday or summer parenting time.
It is important to follow Court Orders, including a parenting time Order and failing to do so has consequences, including an Order for makeup parenting time.
